Privacy & Data Protection Policy
How EnerX processes personal, corporate, and utility telemetry data (including CUPS/PPE identifiers) across our European engineering hubs.
1. Data Controller & European Engineering Hubs
The Data Controller responsible for processing your personal and corporate data is ENERX ECOSYSTEM EUROPE S.L. / Sp. z o.o., operating through regional engineering headquarters in Madrid/Alicante (Spain), Warsaw (Poland), and Munich (Germany).

2. Categories of Data Processed
When you use the EnerX Freedom Calculator, AI Bill Audit (OCR), or Smart Contact Form, we process only the strictly necessary technical and contact parameters:
- Identification & Corporate Data: Full name, company name, role, email address, and telephone number.
- Energy & Site Telemetry: Postal code, site coordinates, Supply Point ID (CUPS in Spain, PPE in Poland, MaLo-ID in Germany), contracted power (kW), and monthly electricity expenditure.
- Uploaded Documentation: Utility invoices (PDF/image) or CAD blueprints voluntarily uploaded for preliminary engineering sizing. Uploaded invoices are processed via encrypted SSL channels and are never sold to third parties.
3. Legal Basis & Purpose of Processing
Processing is carried out under Article 6(1)(a) (explicit consent) and Article 6(1)(b) (pre-contractual engineering feasibility assessment) of Regulation (EU) 2016/679 (GDPR), as well as Spanish Ley 11/2022 General de Telecomunicaciones where automated consultation calls or SMS verification codes are requested.
- Preparation of customized PV, LFP BESS, Backup Power, Eco Park, or Recycling technical-economic proposals.
- Generation of 3D satellite roof models (OpenSolar LiDAR) and municipal tax rebate (IBI / NextGen / FEnIKS / KfW) estimations.
- Dispatch of instant SMS verification codes and requested engineering callback scheduling.
4. Data Retention & Your Statutory GDPR Rights
Lead telemetry is retained for a maximum of 24 months unless converted into an active EPC, PPA, or O&M contract. You have the right to request access, rectification, erasure ('right to be forgotten'), restriction, portability, or objection at any time by emailing privacy@enerx-group.eu.
